General terms and conditions

Abfab Adventures is a touring company that offers travel-related services such as daytrips, multiple-day travels, transfers, and tour guiding. Abfab Adventures Ltd. is based in Varazdin, Croatia and it offers services throughout Balkan region, surrounding countries, and beyond. It is registered at the Varazdin Commercial Court under ID number: 07015312.

The content of the arrangement consists of, or rather the price of the package includes, what is stated in the travel program.

Special services are services that are not included in the price of the package and therefore the traveler pays especially for them. These services should be requested at the point of booking and are an add-on cost to the price of the package. Optional and special services requested by the Client during the travel period are payable to the tour escort or travel agent representative in the currency of the country where the service is provided.

The prices of the packages are published in kuna and calculated according to the prices of services in the reference currency at the sales exchange rate of the tour organizer’s bank on a specific day. The organizer reserves the right to change the published prices in case of changes in accommodation prices, food, transport, and other services, or in case of changes in the value of the currency that are the basis for the calculation of the price of the arrangement. To increase the price of the arrangement up to 10%, no customer consent is required (the increase is calculated in all parts of the payment). In case of an increase of more than 10%, the Client is entitled to terminate the contract without obligation to compensate the damage.

ABFAB ADVENTURES is not responsible for any incidental expenses You may have incurred in reliance on the tour or travel services booked on the Site, including, without limitation, expenses arising from the purchase of visas, vaccinations, non-refundable flights, or of any loss of enjoyment.

Our tours are booked through online reservation system, and paid by using direct bank deposit or Paypal. Once you make the reservation, you will be contacted and directed on how to proceed with the booking. Once the payment is received we will send the voucher to your email address.
You can either pay the deposit or full amount. In case you choose to pay deposit, the balance is paid with credit card within seven days before the start of the tour, or with cash on the day of the tour.

Any cancellation by You must be made by telephone or email and acknowledged by Sunlands. The date on which the request to cancel is received by Sunlands will determine the refund due as follows:

Cancellation 60 days or more before departure: Amount paid less upfront costs. These upfront costs may represent out of pocket expenses of the Sunlands for tickets, transportation deposits and other ancillary expenses.
Cancellation 59 to 31 days before departure: deposit paid or 80% of tour price if paid in full.
Cancellation less than 30 days before departure: no refund

You are strongly encouraged to obtain cancellation insurance. In certain circumstances, this will cover the cost of cancellation.

In some cases, Abfab may cancel a tour due to weather or other circumstance. In a case that the ABFAB ADVENTURES cancels the tour, or does not deliver it as promised, you may choose between a rescheduling of the tour OR a full refund of all monies paid or a credit towards an alternative tour. If you choose to accept a credit, the difference in the cost of the alternative tour will be refunded by ABFAB ADVENTURES or paid by You, as applicable.

All travel documents will be delivered to the Client no later than 5 days before departure unless specified otherwise in the program. Travel documentation includes:

  1. For own transport arrangements: original voucher and eventual written notice;
  2. For bus transportation arrangements: original voucher and travel program;

Because our tours are private by default, we conduct tours starting from one person onwards.

We conduct tours rain or shine. You are advised to carry an umbrella and dress appropriately for weather conditions. In the event of severe bad weather (showers, lightning), ABFAB ADVENTURES may move the tour to another day during your stay in  our country, IF our guide(s) and/or vehicles would be available for that day, i.e. if they are already not reserved by another customer.

ABFAB ADVENTURES acts solely as an guide arranging tours, venue visits and other services and does not assume liability for accidents, delays, injuries, loss or damage due to any act or default of any company, organization or person engaged in rendering service.

By virtue of purchasing tours offered by ABFAB ADVENTURES, and in consideration of being allowed to purchase said tickets and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, you understand, acknowledge, represent, warrant and agree as follows, with the knowledge that the ABFAB ADVENTURES will rely on same:

You desire to participate in tours offered by ABFAB ADVENTURES (The Tours).

You are in good health and suffer from no minor or serious physical or mental injury, illness or disability that would make you especially susceptible to injury or disability while performing any activity organized by ABFAB ADVENTURES;

You fully comprehend and accept all of the risks associated with your participation in the Tours including, without limitation, exposure to unfavorable weather conditions, food sickness, injuries (e.g., without limitation, those arising out of self-inflicted accidents or mishaps, other participants, automobiles, pedestrians and the like) and death;

You grant to ABFAB ADVENTURES the irrevocable, sub-licensable right and authority to use your name, likeness, photograph and/or picture for any and all commercial or non-commercial purposes now known or later developed in perpetuity throughout the universe without further obligation or compensation to you;

Your participation in the Tours is at your own sole risk. You, on behalf of yourself and/or any person or entity claiming through or on your behalf, hereby forever and unconditionally release and discharge the ABFAB ADVENTURES Ltd. (present and former employees, owners, officers, members, managers, partners, contractors, insurers, representatives) from any and all claims, actions, damages, liabilities, losses, costs and expenses in any way arising out of, or resulting from, your participation in the Tours, including, without limitation, any and all claims, actions, and liabilities for death, injury, loss or damage to you, to anyone else, or to any property, regardless of whether or not such injury, loss or damage was caused by the negligence or willful conduct of ABFAB ADVENTURES Ltd.;

Right to Distribute Media: You agree to grant  ABFAB ADVENTURES Ltd. an irrevocable royalty-free worldwide license to use photos and videos taken on its  tours in which you may appear. ABFAB ADVENTURES Ltd. has the right to reproduce, distribute, broadcast, exhibit, edit, digitize or in any other way use the Material by any means and in any form of media, whether existing now or created later, without restriction worldwide, by incorporating the Material into its website, catalogs, books, brochures, magazines or any other publications, or any informational, commercial, promotional or advertising material (henceforth known collectively as the “Works”). You agree that the company is and shall be the exclusive owner of all title, rights and interest in the Material and the Works, including copyright thereof.

Clients must have valid personal travel documents. Invalid documents leading to the cancellation of the travel shall not result in any harmful consequences for Abfab Adventures, and, if Abfab Adventures should suffer additional damages due to such an omission by a Client, the Client must compensate the damages suffered. If a travel document should be lost or stolen during travel, the costs of issuing new documents shall be borne by the Client. Abfab Adventures’s guide shall assist the Client in such a situation, taking care of the usual course of the program. If a certain travel program requires a visa, Abfab Adventures may assist in obtaining such a visa at a special additional fee. Abfab Adventures shall not be held responsible for decisions by customs or police or other state authorities banning passenger’s entry into a particular country.

The client must comply with all foreign exchange and customs regulations, laws and other by-laws of the Republic of Croatia and other countries through which they travel and where they stay.

If the tour cannot be continued because a Client has violated the regulations, all incurred costs shall be borne solely by the person violating the regulations.

Travel to some countries is conditioned by mandatory vaccination against specific diseases. When traveling to such countries, the Client must hold certificates and documents of vaccinations.

In the case of bus transport, a Client may have 2 pieces of personal baggage. Clients must take care of their belongings brought on the bus and are obliged to bring them along whenever leaving the bus. Otherwise, Clients shall be responsible for theft, loss or damage of objects left unattended in the bus.

Complaints are submitted in a written form.

We emphasize that it is in the interest of the Traveler to make sure that every complaint is enclosed in writing and the service provider will endeavor to provide the agreed service, i.e. correct the mistakes.

If no improvement is made even after the complaint, the Customer should ask for a certificate from which it is evident that the service was not provided, i.e. that it was not provided in the stipulated way. The Customer must enclose the certificate to their written complaint. The Customer is to make a written complaint no later than 7 days after the travel has ended. If the Customer should make a written complaint after the expiry of that term, Abfab Adventures is not obliged to take such a complaint into consideration. For resolving the complaints regarding services abroad, one must comply with the rule of reporting the complaint with the issue of a certificate on the spot and the deadline for submitting the complaint.

The organizer must make a written decision regarding the complaint within 14 days of receiving the complaint, and it may postpone the term for making the decision about the complaint by another 14 days on account information gathering.

The Client undertakes to personally meet the conditions anticipated by the regulations of the Republic of Croatia and the country through which or to which they travel, and to observe the house rules in the hotel and other facilities, to cooperate with the representative of the organizer and with service providers.
The Client is personally responsible for any damages caused, particularly for the damages that are the result of failure to observe the contract and these General Terms and Conditions. The Customer shall cover the incurred damages immediately at the hotel reception desk and at another place stipulated by the physical or legal entity who suffered the damages.

Pursuant to the Tourism Act, in case of insolvency or bankruptcy of Abfab Adventures, Clients affected by it while traveling, as well as persons who made down payments for a travel should contact the provider stated on the travel certificate or on another corresponding document as soon as possible.

In the event of a complaint, the buyer of the service from the program in question has the right to a complaint with the program organizer. If the customer is dissatisfied with the decision of the organizer, he has the right to a court arbitration of the competent court in Varaždin.

Abfab Adventures is obliged to provide personal data protection by collecting only the necessary, basic client information that is necessary for the fulfillment of our obligations; inform clients of how they use the data they collect, regularly provide client  the choice of how their data is used, including the ability to decide whether or not to remove their name from the lists used for marketing campaigns. All customer information is kept securely and only accessible to employees who are required to do so as part of their work tasks. All Abfab Adventures employees and business partners are responsible for compliance with the privacy policy.

Clients of Abfab Adventures provide personal data voluntarily. Personal data of clients is needed in the process of realizing the required service and will be used for further mutual communication. Abfab Adventures undertakes not to disclose the personal data of the beneficiary from the country or to give it to a third party except the partners participating in the realization of the contracted service or if it is a legal obligation (e.g hotel, transport provider, border police).

The user’s personal information will be kept in a database in accordance with the Data Storage Policy. An objection to the processing of personal data for marketing purposes will not affect the contracting and/or realization of the requested service.

These Terms and Conditions are an integral part of the agreement that the Client enters into with Abfab Adventures, or with an authorized travel agent to which he has applied for the trip organized by Abfab Adventures. Possible/foreseeable deviations from these Terms and Conditions must be indicated along with the travel program text if they are tour operators – foreign travel organizers. By signing the contract, the Client fully accepts the program and these Terms and Conditions. Issuing of these Terms and Conditions shall cease to be valid for all prior editions.
